The Grand Jury Charges:

Count 1, KRS 514.070 Class D Felony; That on or about January 1, 2007 through July, 2008, the above-named defendant, Kimberly Carpenter, committed the offense of Theft by Failure to Make Required Disposition of Property over $300, in Breathitt County, Kentucky, when, as an employee of the Breathitt County Sheriff, she obtained funds in an amount over $300 from the Sheriff’s Office subject to known legal obligation to make disposition and failed to make the required disposition and dealt with the funds as her own.

Count 2, KRS 514.070 Class D Felony; That on or about January 1, 2008 through December 31, 2008, the above-named defendant, Kimberly Carpenter, committed the offense of Theft by Failure to Make Required Disposition of Property over $300, in Breathitt County, Kentucky, when, as an employee of the Breathitt County Sheriff, she obtained funds in an amount over $300 from the Sheriff’s Office subject to known legal obligation to make disposition and failed to make the required disposition and dealt with the funds as her own.

Count 3, KRS 516.060 Class D Felony; That on or about May1, 2008, the above-named defendant, Kimberly Carpenter, committed the offense of Criminal Possession of a Forged Instrument 2^nd Degree in Breathitt County, Kentucky, when, with knowledge that it was forged, and with intent to defraud or deceive another, she possessed a forged check from the Breathitt County Sheriff’s Fee Account made out to Citizen’s Bank and drawn on the Citizen’s Bank & Trust of Jackson.

Count 4, KRS 516.060 Class D Felony; That on or about May1, 2008, the above-named defendant, Kimberly Carpenter, committed the offense of Criminal Possession of a Forged Instrument 2^nd Degree in Breathitt County, Kentucky, when, with knowledge that it was forged, and with intent to defraud or deceive another, she possessed a forged check from the Breathitt County Sheriff’s Fee Account made out to Citizen’s Bank and drawn on the Citizen’s Bank & Trust of Jackson.

Count 5, KRS 516.060 Class D Felony; That on or about April 16, 2008, the above-named defendant, Kimberly Carpenter, committed the offense of Criminal Possession of a Forged Instrument 2^nd Degree in Breathitt County, Kentucky, when, with knowledge that it was forged, and with intent to defraud or deceive another, she possessed a forged check from the Breathitt County Sheriff’s Fee Account made out to Citizen’s Bank and drawn on the Citizen’s Bank & Trust of Jackson.

Count 6, KRS 516.060 Class D Felony; That on or about April 16, 2008, the above-named defendant, Kimberly Carpenter, committed the offense of Criminal Possession of a Forged Instrument 2^nd Degree in Breathitt County, Kentucky, when, with knowledge that it was forged, and with intent to defraud or deceive another, she possessed a forged check from the Breathitt County Sheriff’s Fee Account made out to Citizen’s Bank and drawn on the Citizen’s Bank & Trust of Jackson.

Count 7, KRS 516.060 Class D Felony; That on or about March 21, 2008 through April 16, 2008, the above-named defendant, Kimberly Carpenter, committed the offense of Criminal Possession of a Forged Instrument 2^nd Degree in Breathitt County, Kentucky, when, with knowledge that it was forged, and with intent to defraud or deceive another, she possessed a forged Invoice from Data Design, Inc. to the Breathitt County Sheriff.

Count 8, KRS 516.060 Class D Felony; That on or about April 16, 2008, the above-named defendant, Kimberly Carpenter, committed the offense of Criminal Possession of a Forged Instrument 2^nd Degree in Breathitt County, Kentucky, when, with knowledge that it was forged, and with intent to defraud or deceive another, she possessed a forged Purchase Order from the Breathitt County Sheriff’s Dept. to Data Design, Inc.

Count 9, KRS 514.040 Class D Felony; That on or about May 1, 2008, the above-named defendant, Kimberly Carpenter, committed the offense of Theft by Deception over $300 in Breathitt County, Kentucky, when she obtained funds in an amount over $300 from the Breathitt County Sheriff’s bank account by deception, with intent to deprive the Sheriff’s office thereof.

Count 10, KRS 514.040 Class D Felony; That on or about April 16, 2008, the above-named defendant, Kimberly Carpenter, committed the offense of Theft by Deception over $300 in Breathitt County, Kentucky, when she obtained funds in an amount over $300 from the Breathitt County Sheriff’s bank account by deception, with intent to deprive the Sheriff’s office thereof.

Count 11, KRS 522.050 Class D Felony; That on or about May 2007 through July 2008, the above-named defendant, Kimberly Carpenter, committed the offense of Abuse of Public Trust in Breathitt County, Kentucky, when, as a public servant/employee of the Breathitt County Sheriff, she obtained tax payments from members of the public and failed to make the required disposition of said payments, and dealt with them as her own, in an amount less than $10,000, and a subsequent audit revealed a shortage of accounts.
