SECOND READING & ADOPTION OF BUDGET ORDINANCE FOR FISCAL YEAR ¾ Chief Friley and members of the fire department expressed concerns of how the Insurance Premium Tax is to be used. They feel this tax should be used for fire department use only. Mayor Miller feels that once the bond issue is paid that the Insurance Premium Tax could be used for any public property. Upon discussion between Mayor and Council, it was decided to table the adoption of the budget until the original ordinance can be faxed from the State Department of Insurance. Chief Friley also reminded Council that another fire station will be needed to store new hazardous material. Motion was made by Councilman Patrick seconded by Councilman Morgan to go into Executive Session to discuss legal matters. MAYOR’S UPDATES City Hall Project-98% complete with a walk through scheduled for June 30, 2003. The streets have been repaired in front of the Jefferson Hotel on Main Street. White Flash II has signed an agreement to pay tourism taxes. Legal action will be taken against Jones Foods since there was no response for payment. ENGINEERING REPORT There were 4 bids on the WaterPlant Project. CDP Engineers recommended accepting Judy Construction which was the lower bidder of $5,818.500.00. The lines & tank Charles Construction was the lower bidder of $498,430,00.00. The Rural Development loan will be increased to $487,102.00. The Alt # 1 for Belcher Fork amount was $96,600.00. Motion to accept the above was made by Councilwoman Rogers seconded by Councilman Turner. Upon call for vote, all voted “Aye”. Mayor asked Council for approval for a short term loan for expenses incurred for the 3 houses at the Water Plant Site (Hall $2 14, 165.00, Herald $15,300.00, Neace $9,665.00) Motion to approve the short term loan of $39,130.00 from the First National Bank was made by Councilman Morgan seconded by Councilwoman Rogers. Upon call for vote, all voted “Aye”. APPROVAL OF MINUTES, REPORTS & BILLS Councilwoman Hendrickson asked the status of payment for the Doug Back property. Mayor said he was confident that the city will bet a grant of $75,000.00 to cover the cost if not the KLC bond issue interest rate can be rolled over to save approximately $35,000.00 to $50,000.00. She stated that Paul and Debbie Haddix has fixed their yard themselves. She told all that her daughter, Whitney is volunteering her time at the city pool this summer. Councilwoman Hendrickson also asked for a Tourism Promotion Plan from the Tourism Board. Mayor advised that Ted Edmonds is co-sponsoring a bill so the city can better utilize the money. Mayor advised all that he has spoken with Kentucky American Water Co. to help in management and operation of water & sewer maintenance and accounts in which someone from their office would spend approximately 2 days a week in these areas. Some of the needed problem areas are: 1. The plant not providing as much water as the reports say. 2. Meters not registering 3. Meter readers. Mayor is taking steps to correct these problems starting with ordering 5 new meters in town for meters that are not in proper working order. Also water plant operator Cliff Hays has written a letter to the Divison of Water concerning problems at the plant in which he was not authorized to do. Councilwoman Rogers asked the status of the problem at Hays Branch. Mayor will check into this further. She also asked about a walkway between LBJ to the hospital. Mayor told her when it was discussed previously, some of the residents were against the idea. She asked for better police patrol on Sycamore Street and finding needles on the drains on this street. She advised Mayor for employees to adhere to confidentiality issues. Mayor told all the Debbie Haddix is putting a trailer court in on Highway 30 and Paul Mullins on Highway 52, it would be beneficial for the city to help them with the cost of 2 lift stations in order to help alleviate the sewer problems at Douthitt Park. Comments From The Audience: There were no comments from the audience State Of The City Report Parks - Mayor is in the process of meeting with Doug Back’s attorney to speed up the condemnation process and work out final details. There has been a grant submitted for the old city park and the city is in the final applications for approval. If this grant is not obtained the city can refinance the loan at the Douthitt Park to include renovations to the old city park. FEMA has allowed all damages submitted from the flood for the exception of the basketball courts. Another grant was submitted for Landscape Design to the Forestry Division this was in conjunction with the Housing Authority (it is a 50% - %50 grant). Water System - Advertised for bids June 18, 2003 in the Lexington Herald. 17 sets of plans have been picked up from Lynn Blue Print. It must be advertised twice in order to meet EDA guidelines, the first ad ran May 11,2003 . Water company is purchasing 36 meters to replace suspected malfunctioning meters in town. Also a testing and re-building kit will be purchased to repair ones that can be repaired. Five 2inch meters will also be purchased for commercial meters to be replaced in places such as the hospital and housing authority etc.. Water Plant Site (CSX properties)-Appraisals have been completed and relocation costs will have to be included for the residents for a total $176,042.50. This was authorized in the $100,000.00 previously borrowed from the bank. Sewer- All Lift Stations are in working order from the flood damages. The Water/Sewer Ordinance needs to be amended to include a 3% automatic increase each year for the sewer rates. Streets- Combs Street has been blacktopped through the state highway office. Sycamore & Collier Avenue need to be fixed also-they will be repaired soon. Bridge Hollow will be fixed in conjunction with the new water plant. Panbowl Lake Road has been turned into the Municipal Aid Fund for repairs. Funds need to be in reserve for fixing collapsed drains and purchase of a new dump truck. Finances Of The City- Mayor told all that the finances of the city were in pretty good shape but could always be better. He stated that the city would replace the police cruiser that was involved in the accident on Jetts Drive (involving John Marshall) insurance money will be used for this purchase. Vice Mayor Wolfe asked the possibility of more cruisers for police department use. Mayor explained that under Homeland Security Congressman Rogers will have X amount of funds for purchases of police equipment in which the city can apply for in November. He also explained that the police department has expressed interest for take home cars-which for 9 policemen is not feasible at this time when a dump truck and street maintenance is more important right now. Mayor advised that he has applied for a grant through KRADD to pay new furniture and computers at City Hall. Future Projects - Two Sewer Projects have been submitted for funding. The Low Flow Dam is being pursued. AML agreed to re-open the study for South Fork/Quicksand area. Bell South & AEP are to meet June 11th concerning the underground cables and phone lines for the judicial center/street scape project. Budget Ordinance for 2003-2004 - First Reading Mayor went over line items for the budget. Upon auditors recommendations the Tourism and Public Properties budget amounts were included this year. Upon discussion, motion to approve the first reading of the 2003-2004 budget was made by Councilman Patrick seconded by Councilman Turner. There was some confusion because they were shut off at 9:00 P.M. and the residents using the park assumed it would be 11:00 P.M. The correct times should be posted and placed in the paper for all to review. Mayor will get with the Parks Director and take care of this problem. Vice Mayor Wolfe asked for consideration in hiring low income kids for the summer season. Because certification costs $300-$600 for lifeguards she suggested having sponsors for children who could not afford the cost. Mayor told her this was a good idea and told all that the pool is being prepared for the summer season. Councilwoman Hendrickson asked for increased police patrol on Sycamore street because she has had several calls on this matter. Mayor will inform Chief Caudill of this request. Councilwoman Hendrickson asked the status of Paul & Debbie Sebastian’s yard on Lakeside which was dug up by the water company over a year ago. Mayor will talk to Superintendent Cundiff about this matter in which he thought was already taken care of. Councilman Turner asked why Wal Mart Shopping Center has problems with the water pressure so often. He was told that they have their own tank in which they maintain and is one of the first to lose pressure when the system is shut off because of the boil water advisories. Mayor has advised the water plant to be more cautious and not to shut off all areas of the system when only one section is affected which should help this situation. Councilwoman Hendrickson asked if something could be done about the odor at the sewer plant on Highway 15. Mayor will have some chemicals ordered to help this problem. Vice Mayor Wolfe asked the status of the Court Workers who could help clean dump sites around Jackson. Mayor will contact the court to obtain these workers. Need to start new fire station City Council Meeting by Danny Fugate June 26th, 2003 Meeting opened with prayer First on the agenda was the 2003/2004 Budget Addressing the City Council was Chief Roger Friley representing the Jackson Fire Department and Fire Fighters, who were present with around 20 in all. Chief Friley and the Fire Fighters were concerned that the City had taken money out of the Jackson Fire Department Funds and not returned. Some of this money, according to Chief Friley, was to make payroll and to help fund the renovation of City Hall. Mayor Mike Miller stated that ordanances were put in place in the past so that the Insurance Tax levied in the 1980's was meant to pay off debt toward the Fire Department. The debt has been paid off according to Mayor Miller, who also stated that some of the funds should be used to help fund other projects that need to be done. Arch Sebastian, who was in attendance with the Fire Fighters, stated that there were guidelines in place which govern the tax itself when it was initially set up. The Mayor sent Angie Combs to City Hall to try to retrieve them. Chief Friley also stated that the Fire Department will be receiving $ 693,000.00 from FEMA to head up the Regional Hazardous Material Project which will be located in Jackson. This will required a need for an additional bay. Following many questions from the City Council Members, Chief Friley stated that he would just like to see that when money was taken from the Fire Department fund that it be returned at some point. When asked to vote on the budget, the Council Members felt it necessary to put it off until a later date. They will do it by the 30th of June and the meeting would be continued after tonight by going into recess following all other business tonight. Next in attendance were representatives of the Breathitt Youth Foundations, Buddy Watkins and Danny Fugate. Mr. Fugate stated to the City Council that their organization appreciated everything that has been in the past and looks forward to moving to the old City Park. He also express thanks to the Parks Board, whom he said has helped many citizens in the City and County. Mr Watkins stated that the BYF would like to know when the fields would start being developed and that there was fence needing to be taken down not only at Lakeside but also at the fields behind LBJ School, which Superintendant Eden stated could be moved.
